Liability Waiver
Waiver of Liability, Assumption of Risk, and Indemnity Agreement
IMPORTANT:
This agreement contains a waiver of your right to sue, a release of all claims, and other provisions that affect your legal rights. Please read it carefully.
Waiver
In consideration for being permitted to enter Austin Surf Lodge, located at 1017 Indian Mound Rd, Spicewood, TX 78669, and to participate in activities and use the premises, facilities, staff, equipment, and services (collectively, the “Premises”), I, on behalf of myself and my heirs, representatives, and assigns, hereby release, waive, discharge, and agree not to sue the “Released Parties” for any claims, damages, or liabilities, including those arising from negligence.
“Released Parties” include Austin Surf Lodge, LLC, Lake Life Vibes, LLC, SWET, LLC, Leap RE Holdings, LLC, their owners, affiliates, employees, contractors, sponsors, service providers, and any individuals involved in the operation of the Premises.
Description of Premises & Activities
Activities may include, but are not limited to:
- Food and beverage preparation and consumption
- Cold plunges, ice baths, saunas, and wellness treatments
- Physical activity, stretching, and fitness classes
- Watersports (wake surfing, wakeboarding, tubing, paddleboarding, swimming, boating)
- Fire pits, yard games, and social gatherings
- Massage therapy, chiropractic services, IV treatments, and red light therapy
Assumption of Risk
I understand that participation is voluntary and involves inherent risks that cannot be eliminated. These risks may include, but are not limited to:
- Serious injury, illness, or death
- Drowning, heart attack, stroke
- Burns, frostbite, hypothermia, heat exhaustion
- Injuries to bones, joints, or muscles
- Concussions or loss of consciousness
- Food-related risks (allergic reactions, choking, illness)
- Exposure to viruses or bacteria, including COVID-19
- Animal or insect bites
I confirm that I am aware of these risks, physically able to participate, and voluntarily choose to do so.
Indemnification
I agree to indemnify and hold harmless the Released Parties from any claims, damages, costs, or expenses (including legal fees) arising from my participation, actions, or breach of this agreement.
Representation of Age
I confirm that I am at least 18 years old.
Minors may only participate with the consent and supervision of a parent or legal guardian, who assumes full responsibility on their behalf.
Severability
If any part of this agreement is found to be invalid, the remaining provisions will remain in full effect.
Governing Law
This agreement is governed by the laws of Burnet County, Texas.
Electronic Consent
By clicking to accept or signing electronically, I agree that this constitutes a legally binding signature.
Acknowledgment
I have read and fully understand this agreement. I acknowledge that I am waiving significant legal rights, including the right to sue, and I agree to these terms voluntarily.
